These Terms & Conditions ("Terms") govern your use of the Asian Vibe website, mobile applications and related services (together, the "Platform").

By creating an account or using Asian Vibe, you agree to these Terms. If you do not agree, please do not use the Platform.

Asian Vibe is intended for users aged 18 or over.

By creating an account, you confirm that:

You are at least 18 years old.

The information you provide is accurate and not misleading.

You will keep your account information up to date.

You will use the Platform lawfully and in accordance with these Terms.

We may request information or use third-party services to verify certain account or profile information.

You are responsible for maintaining the security of your account and for activity carried out through it.

You must not:

Create an account using another person's identity.

Create multiple or misleading accounts to deceive others.

Share your account credentials with another person.

Attempt to access another user's account.

Use the Platform for fraudulent or unlawful purposes.

We may take reasonable steps to protect accounts, users and the Platform from misuse.

Asian Vibe may offer profile or identity verification using third-party verification providers.

A verification indicator means that the applicable verification process has been completed. It does not guarantee a person's identity, character, intentions, qualifications, honesty or behaviour.

You should use reasonable caution when communicating with or meeting other users.

Asian Vibe allows users to create, upload, publish and share content, including:

Profile information and photographs

Posts, comments and messages

Community content

Job listings

Event listings

Business pages and information

Links and other materials

You remain responsible for content you submit.

You must have the necessary rights and permissions to upload or share your content.

You must not upload or share content that:

Is unlawful or fraudulent.

Is abusive, threatening or harassing.

Is discriminatory or hateful.

Impersonates another person or organisation.

Infringes copyright, trade marks, privacy or other rights.

Contains malicious software or attempts to compromise security.

Misleads users about a person, business, job, event or opportunity.

Promotes illegal activity.

Otherwise breaches these Terms or applicable law.

Licence to Asian Vibe

You retain ownership of your content.

By submitting content to Asian Vibe, you grant Omiyo Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and technically process that content as reasonably necessary to operate, maintain, improve and promote the Platform.

This licence ends within a reasonable period after your content is deleted or your account is closed, except where retention is reasonably necessary for legal, security, dispute-resolution or legitimate operational purposes.

Asian Vibe may provide private messaging, community discussions, profile sharing and other communication features.

You are responsible for your interactions with other users.

You must not use these features for harassment, spam, scams, impersonation, unlawful activity or persistent unwanted contact.

Where permitted by law and necessary for safety, security, moderation or legal compliance, Asian Vibe may review or act on content or activity.

Asian Vibe may allow users and businesses to publish job opportunities, events, business pages and related information.

Asian Vibe is a platform for discovering and sharing such information. Unless explicitly stated otherwise, Asian Vibe does not guarantee that:

A job or business is genuine or suitable.

An event will take place as advertised.

A listing is accurate or complete.

A person or organisation will fulfil its promises.

A transaction between users will be completed.

You should independently verify important information before making decisions, payments or commitments.

Asian Vibe may provide or integrate features such as meeting links, calendar functionality, video-meeting services, sign-in services and other third-party tools.

These services may be operated by third parties and may have separate terms and privacy policies.

Asian Vibe is not responsible for the availability, content, conduct or performance of third-party services outside our reasonable control.

You agree not to:

Harass, threaten, bully or abuse another person.

Discriminate against others.

Scam, defraud or deceive users.

Impersonate another person or organisation.

Collect or misuse another user's personal information.

Send spam or unauthorised commercial communications.

Upload unlawful or harmful material.

Infringe intellectual-property or other legal rights.

Attempt to bypass security or access restricted areas.

Scrape, copy or systematically collect Platform data without permission.

Interfere with the operation or security of Asian Vibe.

Use Asian Vibe in a manner that violates applicable law.

We may take reasonable and proportionate action, including:

Removing or restricting content.

Limiting particular features.

Warning users.

Suspending accounts.

Terminating accounts.

Reporting matters to appropriate authorities where legally required or appropriate.

Where appropriate, users may request a review of moderation or account decisions by contacting us.

Our actions will be based on applicable law, these Terms and the circumstances of the matter.

Asian Vibe may offer paid features through:

One-time payments; and

Recurring subscriptions.

The applicable price, billing frequency, duration and key conditions will be presented before you complete a purchase.

Payments may be processed by third-party payment providers, including Stripe.

Subscriptions

Where you purchase a subscription:

Your subscription will renew according to the plan you selected unless cancelled.

The applicable renewal price will be communicated when you subscribe and as otherwise required by law.

You can cancel your subscription using the available cancellation process.

Cancellation normally prevents future renewals but does not automatically provide a refund for a period already paid for, except where required by law or our applicable refund terms.

We will provide any legally required information and cancellation rights for subscription purchases. UK subscription rules also include requirements concerning clear pre-contract information, reminders and straightforward cancellation.

Nothing in these Terms limits or excludes any rights or remedies that you have under applicable consumer law.

Where Asian Vibe provides digital services or digital content to consumers, we will comply with applicable statutory requirements.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

The Asian Vibe name, branding, logos, designs, software, graphics and other original Platform materials are owned by or licensed to Omiyo Ltd unless stated otherwise.

You may use the Platform for its intended personal or authorised business purposes.

You must not copy, reproduce, modify, distribute, sell or commercially exploit Asian Vibe's intellectual property without permission.

Asian Vibe may contain links, advertisements, integrations or content provided by third parties.

We do not control all third-party content or services and cannot guarantee their accuracy, availability or reliability.

Your use of third-party services may be subject to their own terms and privacy policies.

We aim to provide a reliable and secure Platform, but we cannot guarantee that Asian Vibe will always be available, uninterrupted or error-free.

We may temporarily modify, suspend or restrict features where reasonably necessary for maintenance, security, technical reasons, legal requirements or other legitimate operational reasons.

We will take reasonable steps to minimise disruption where practicable.

You may stop using Asian Vibe or request closure of your account at any time.

We may suspend or terminate an account where reasonably necessary, including where:

These Terms are seriously or repeatedly breached.

There is suspected fraud or unlawful activity.

The account creates a significant safety or security risk.

Action is required by law.

Continued access would materially harm the Platform or other users.

Where appropriate and legally permissible, we will provide information about the reason for the action and any available review or appeal process.

Termination does not remove rights or obligations that arose before termination.

Asian Vibe provides tools intended to help users connect safely, but online interactions involve risks.

You are responsible for making sensible decisions about what information you share and who you communicate or meet with.

Do not share sensitive personal information unnecessarily, send money to people you do not trust, or assume that a verification badge guarantees a person's intentions or behaviour.

We are responsible for providing the Platform with reasonable care and skill as required by applicable law.

We are not responsible for matters outside our reasonable control, or for independent actions, content, services or transactions of other users or third parties.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or your statutory consumer rights.

Any limitation of liability will apply only to the extent permitted by applicable law.

We may introduce, modify or remove features from time to time.

Where a change materially affects a paid service or your contractual rights, we will provide appropriate notice where required by law.

We may also update these Terms when reasonably necessary, including to reflect changes to the Platform, law or our services.

The latest version will be made available on the Platform.

Our Privacy Policy explains how we collect, use, store and protect personal information.

By using Asian Vibe, you acknowledge that your personal information will be handled in accordance with that Privacy Policy.

These Terms are governed by the laws of the United Kingdom, subject to any mandatory consumer-protection rights that apply to you under the laws of your country of residence.

Where legally permitted, disputes will be subject to the courts with appropriate jurisdiction.

Nothing in this section prevents you from exercising mandatory legal rights available to you in your country of residence.
